Terms & Conditions

These terms govern quotations, sales, installations, repairs, support and other services provided by Braintech Computer Services. Please read them before placing an order or approving work.

Important: Nothing in these terms excludes rights or remedies that cannot lawfully be excluded under applicable Indian law, including consumer-protection law. A quotation, invoice, warranty card or written work order may contain additional product- or project-specific terms; if there is a conflict, the more specific written term applies to that transaction, subject to law.

1. Scope and acceptance

“Braintech”, “we”, “us” or “our” means Braintech Computer Services, B-10 Bombay Shopping, Bharuch, Gujarat, India. “Customer”, “you” or “your” means the person or entity requesting or purchasing products or services. These terms apply to our website, quotations, orders, product sales, CCTV and networking projects, installation, configuration, repair, annual maintenance and technical support. You accept them by placing an order, paying an advance, approving a quotation or work order, accepting delivery, or allowing work to begin.

You confirm that you are legally competent and, where acting for an organisation, authorised to bind it. Any change must be agreed by us in writing.

2. Pricing, GST and invoices

  • Prices are in Indian Rupees. GST and other applicable taxes are charged as shown on the quotation or tax invoice. Unless expressly stated “inclusive of tax”, quoted prices are exclusive of GST.
  • Freight, cabling, civil/electrical work, lifts, travel outside the agreed area, consumables, licenses and other third-party costs are extra unless expressly included.
  • Quotations remain valid only for the stated period and are subject to stock, supplier pricing, exchange-rate movement and specification confirmation. Obvious clerical or pricing errors may be corrected before supply.
  • Customers must provide accurate billing, GSTIN and delivery details before invoicing. Any input-tax-credit eligibility or filing consequence depends on applicable law and the accuracy/timeliness of customer information; we do not guarantee a customer’s tax treatment.
  • A proper invoice should be retained for warranty, return and service claims.

3. Orders, specifications and availability

An order becomes binding when we accept it or begin procurement/work. Product images are illustrative; model, colour, packaging, firmware or minor specifications may vary where the supplied item is commercially equivalent and the customer has agreed. Availability and delivery dates are estimates unless expressly guaranteed in writing. Custom-configured, specially procured, activated-license, cut-cable and made-to-order items may not be cancelled after procurement begins. Reasonable cancellation or restocking costs may apply where lawful and disclosed.

4. Payment, title and credit

  • Payment milestones, advance and balance are as stated in the quotation or invoice. Unless credit is approved in writing, full payment is due before or on delivery/commissioning.
  • Goods remain our property until all amounts for those goods are received, while risk of loss or damage passes on delivery to the customer or carrier, to the extent permitted by law.
  • Approved credit is discretionary and may be suspended or withdrawn. Overdue undisputed sums may attract reasonable interest or recovery costs stated on the invoice and allowed by law.
  • We may pause delivery, licenses, remote support, site work or handover for overdue amounts after reasonable notice. Customers may not withhold undisputed payments because of a separate claim.

5. Delivery, inspection and site access

The customer must provide safe, timely site access, an authorised representative, suitable power/network infrastructure and accurate delivery information. Please inspect packages, quantities, model numbers and visible condition at delivery. Transit shortage or visible damage should be noted on the delivery record and reported promptly with photos. Delay caused by the customer, unsafe conditions, access restrictions, third parties, carrier disruption, force majeure or government action may extend timelines and may involve reasonable additional cost.

6. Returns, replacement and cancellation

  • Change-of-mind returns are not automatic. Any return accepted by us must be pre-authorised, complete, unused, in resaleable condition and include original packaging, accessories, serial labels and invoice.
  • Dead-on-arrival, wrong-item, shortage or visible-damage claims should be reported as soon as reasonably possible, preferably within 48 hours of delivery. This reporting period helps verification and does not reduce any non-waivable statutory right.
  • After inspection, an eligible defective item may be repaired, replaced, credited or refunded as required by applicable law and the relevant manufacturer/distributor policy.
  • Opened consumables, software/license keys, activated subscriptions, hygiene-sensitive items, cut cable, custom-built/configured systems and special-order items are normally non-returnable unless defective or otherwise required by law.
  • Data must be backed up and removed where practical before any device is returned. We are not responsible for customer data left on returned equipment except to the extent liability cannot be excluded by law.

7. Product and workmanship warranty

Manufacturer-branded goods carry only the manufacturer’s or authorised distributor’s warranty for the applicable model and region. Warranty period, coverage, on-site/carry-in process, repair time and remedy are controlled by those terms. Braintech may assist with coordination but does not independently extend the manufacturer’s warranty unless expressly stated in writing.

Warranty generally excludes physical/liquid/fire damage, power surge, lightning, pest damage, misuse, accident, unauthorised repair, broken seals, corrosion, improper environment, incompatible accessories, normal wear, consumables, batteries beyond stated coverage, data loss and software/virus issues. Our installation workmanship is covered only for the period stated on the quotation or invoice and does not cover later alteration, third-party interference or external infrastructure failure. Proof of purchase and serial number may be required.

8. Installation, repair and support services

  • Scope is limited to the written quotation/work order. Concealed wiring, civil work, painting, trenching, scaffolding/lift, electrical earthing, internet service, permits and restoration are excluded unless listed.
  • Customer must disclose site hazards and obtain landlord, society, employee, neighbour, government or other permissions. We may stop unsafe or unlawful work.
  • Remote access is used only with authorisation. The customer should supervise access, protect credentials and change temporary/default passwords after handover.
  • Estimates for diagnosis and repair may change after opening/testing. Replaced parts will be returned if requested in advance and permitted by manufacturer/exchange policy.
  • Before service, the customer must maintain a verified backup. Hardware or software work can expose pre-existing faults. We are not liable for loss of data, settings or business time where reasonable care was used, subject to applicable law.
  • Service visits, response times and annual maintenance cover only what is expressly written; parts, consumables and third-party charges are excluded unless stated.

9. CCTV, recordings, cybersecurity and privacy responsibility

The customer is the owner/controller of CCTV systems, recordings, access logs and other personal data processed through equipment installed or serviced for the customer. The customer is responsible for lawful purpose, notices/signage, consent where required, camera placement, audio recording, retention, disclosure, employee/visitor privacy, police or authority requests, and compliance with applicable privacy, information-technology, workplace, housing and surveillance laws.

We will not knowingly install or configure equipment for covert, intrusive or unlawful surveillance. The customer must not aim cameras into locations where people reasonably expect privacy or monitor third-party property without lawful authority. Internet-connected systems carry cyber risk; the customer is responsible for strong unique passwords, multi-factor authentication where available, firmware updates, secure networks, controlled user access, backup and prompt removal of former users. Unless a separate written data-processing or monitoring service is agreed, we do not continuously access, monitor, store or back up customer footage and cannot guarantee prevention of intrusion, theft, outage or data loss.

10. Third-party products, software and online services

Operating systems, applications, cloud storage, mobile apps, internet links, remote-view services, firmware and subscriptions are supplied by third parties and are governed by their license, privacy, availability and warranty terms. The customer must use genuine, properly licensed software. We do not control third-party updates, service discontinuation, compatibility changes, ads, account recovery, data practices or outages. Subscription renewals, internet charges and cloud storage are the customer’s responsibility unless expressly included. We may refuse pirated, cracked or licence-bypassing requests.

11. Limitation of liability

We will perform services with reasonable care and skill. To the maximum extent permitted by law, Braintech is not liable for indirect, incidental, special, punitive or consequential loss; loss of profit, revenue, opportunity, goodwill, recordings or data; business interruption; or third-party claims arising from product failure, cyber incident, customer configuration, unlawful use or third-party services. For claims where a limitation is lawful, our aggregate liability is limited to the amount paid to us for the specific product or service giving rise to the claim.

This section does not exclude or limit liability that cannot lawfully be excluded or limited, including liability for fraud, wilful misconduct, or any mandatory consumer remedy. The customer should maintain appropriate insurance, backups, redundancy and physical security; CCTV and IT systems reduce risk but cannot guarantee prevention or evidence capture.

12. Intellectual property

Product brands, software and documentation belong to their respective owners. Braintech retains rights in its website, branding, quotations, layouts, checklists, configurations, documentation and other original material. On full payment, the customer may use transaction-specific deliverables internally for their intended purpose. No trademark, copyrighted content, license key, confidential method or third-party material may be copied, resold or distributed without permission.

13. Prohibited and unlawful use

Products and services must not be used for unlawful surveillance, stalking, harassment, discrimination, fraud, hacking, piracy, sanctions/export violations, evidence tampering, privacy invasion, intellectual-property infringement or any activity prohibited by law. The customer must not ask us to disable lawful safeguards, conceal an offence, falsify invoices/serial numbers, install unlicensed software or bypass access controls. We may refuse or stop work, preserve records and cooperate with lawful authorities where required by law.

14. General terms

  • Privacy: Contact, billing, site and device information may be used to quote, supply, support, collect payment, prevent fraud, maintain records and meet legal obligations. We do not sell customer personal information. Necessary information may be shared with manufacturers, distributors, service partners, payment providers, advisers or authorities for those purposes.
  • Confidentiality: Each party should protect the other’s non-public business and technical information, except where disclosure is authorised or required by law.
  • Force majeure: Neither party is responsible for delay beyond reasonable control, including disaster, fire, epidemic, strike, transport/supply disruption, telecom or power outage, import restriction or government action.
  • Notices: Transaction notices may be sent by invoice, letter, WhatsApp, SMS or other contact method supplied by the customer.
  • Severability and waiver: If a provision is unenforceable, it is adjusted or removed only to the minimum extent required; the rest continues. Delay in enforcement is not a waiver.
  • Updates: Website terms may be updated prospectively. The version accepted when an order is placed generally governs that transaction unless law or a later written agreement requires otherwise.

15. Governing law and jurisdiction

These terms are governed by the laws of India. The parties should first try in good faith to resolve a dispute through written communication. Subject to any mandatory consumer forum or other non-excludable jurisdiction, courts and competent tribunals at Bharuch, Gujarat will have jurisdiction. Nothing here prevents either party from seeking urgent lawful relief or using a statutory consumer-grievance mechanism.
